DEED HUGH STEPHENSON FROM CHARLES COULTER
This Indenture made the Twenty sixth day of April in the year of our Lord One thousand seven hundred and seventy nine between Charles Coulter of the County of Sussex of the State of Delaware of the one part and Hugh Stephenson of the county aforesaid of the other part. Witnesseth that whereas there is a Certain Tract or Parcel of Land situate lying and being in the Broadkiln hundred and County aforesaid and the north west side of a called the Mill Creek Branch which said tract of land was granted by Patent bearing date of second day of the second month One thousand six hundred and eighty six unto a certain John Richardson for the Quantity of five hundred acres of land which said Patent was assigned over to a certain Charles Coulter and Samuel Coulter (which said Samuel Coulter was the Father of the above named Charles Coulter Party to these present by a certain Joshua Fisher by vertue of which assignment the said Samuel Coulter became seized of one hundred seventy five acres on the south side of the aforesaid tract of land and the said Samuel Coulter by his writing obligatory under his hand and seal bearing date the fifteenth day of February One thousand seven hundred and forty three for did oblidge himself to convey the said one hundred and seventy five acres of land to a certain Richard Tamplin for the consideration of the sum of Thirty five pounds current money of the Government of the Counties of Newcastles Kent and Sussex on Delaware and the said Richard Tamplin dying Intestate before any conveyance was made to him for the said one hundred and seventy acres of land by the aforesaid Samuel Coulter James Tamplin eldest son and administrator of all and singular the goods and chattles of Richard Tamplin deceased assigned over the said Bond unto a certain Sam Wyatt and the said Sam Wyatt assigned the same over to the above named Hugh Stephenson and the aforesaid Samuel Coulter dying Intestate the right of the said one hundred and seventy five acres of land devolved to the above named Charles Coulter son of the aforesaid Samuel Coulter which said one hundred and seventy acres of land as butted and bounded as follows. . Beginning at a corner maple of the Edge of the Run of the aforesaid Branch and the north west side thereof and running from thence north fifty five degrees west three hundred and eighty perches to a corner post standing in the line of John Neills land then with the line of the said land south thirteen degrees west to a corner post standing in the line of Edward Stephenson land then south fifty five degrees east till it intersect the aforesaid Branch then down the water courses thereof to the first bounder or place of Beginning containing and laid off for one hundred and seventy five acres be the more or less. Now This Indenture Witnesseth that the said Charles Coulter and in consideration of the sum of Thirty five pounds current money of the Counties of Newcastles Kent and Sussex on Delaware to the said Samuel Coulter (his Father) in hand paid by the said Richard Templin the receipt whereof the said Charles Coulter doth hereby acknowledge and himself to be therewith fully contented satisfied and paid. Hath granted bargained and sold and by these presents do grant bargain and sale unto the said Hugh Stephenson his heirs and assigns forever all his right Title Interest Property clam and demand of in or to the aforesaid one hundred and seventy five acres of land. Together with all and singular the buildings improvements hereditaments and appurtinances unto the same belonging or in any wise appurtaining as also all the estate right Title Interest Property Claim and Demand of him the said Charles Coulter his heirs and assigns to every part and parcel thereof. To Have and to Hold the said one hundred and seventy five acres of land and every part and parcel thereof is the said Hugh Stephenson his heirs and assigns to the only proper use and behoof of him the said Hugh Stephenson his heirs and assigns forever and I the said Charles Coulter for myself my Excís Admn and assigns do covenant and grant to and with the said Hugh Stephenson his heirs Exc Adminís and assigns that the said Charles Coulter the said one hundred and seventy five acres of land against the lawful claim or claims of me the said Charles Coulter my heirs or assigns and all manner of person or persons whatsoever claiming from by or under me them or any of them to the said Hugh Stephenson his heirs and assigns forever shall and forever will warrant and defend and I do hereby make constitute and appoint William Perry of the county aforesaid my true and lawful attorney to appear for me at a Court of Common Pleas to be held at the town of Lewes for the County of Sussex on the first Wednesday of May next or any other subsequent court and then and there in my name Room and Stead to acknowledge this deed in open court.
