WILLIAM HALL FROM THOMAS TAMPLIN

This Indenture made the Tenth day of April in the year of our Lord one thousand seven hundred seventy five Between Thomas Tamplin of the County of Sussex on Delaware yeoman on the one part and William Hall of the same county yeoman of the other Part. Witnesseth that whereas there is a certain tract of land situate lying and being in Indian River Hundred in the County afsd granted by Properitaries Warrant to a certain Thomas Bryan late deceased who by his deed of sale duly perfected under his hand and seal conveyed it to William Blizard and the said William Blizard being so seized thereof conveyed the said tract of land to Ezckiel Jackson & the said Ezchiel Jackson being so seized thereof did by his writing obligatory under his hand & seal oblige himself his heirs & to convey the same to a certain Richard Tamplin but the said Richard dying before any conveyance was made the said Ezchiel Jackson conveyed the said tract of land to the heirs of the said Richard Tamplin and James Tamplin eldest son of the afsd Richard Tamplin deceased who died Intestate preferred a petition to the Orphans Court for the county afsd praying the said Court to appoint five freeholders persuant to law to divide the said land among the several heirs of the afsd Richard Templin which Petition was granted and the said freeholders after viewing the said land and maturely considering the same made return that the said land would not admit of division among the several heirs of the said Richard Tamplin without marring and spoiling the whole whereas upon the said court appointed three freeholders to set a valuation on the said land agreeable to law which said freeholders is obedient to the said order and appointment made return of their valuation of the same. Whereupon James Tamplin eldest son of the afsd Richard Tamplin accepted the same at the valuation and the said James Tamplin being so seized of the said land did by his deed of sale duly perfected bearing date the third day of August in the year of our Lord seventeen hundred and seventy three convey the same to the above named Thomas Tamplin party to these persons which said tract or parcel of land is butted & bounded as follows. Beginning at a corner white oak & running from thence south twenty six degrees east eighty two perches to a corner small white oak thence south fifty nine and one quarter degrees east one hundred & forty perches to a corner rod standing on the south side of a swamp thence through said swamp north a quarter of a degree west sixty six perches to a corner post standing in a swamp then north one and a quarter degrees west eighty four perches to a corner white oak then north forty six and three quarter degrees west sixty nine perches to a white oak and from thence south sixty six degrees west one hundred and four perches to a white oak thence north forty nine degrees west fourteen perches to the first bounder or place of beginning containing and laid out for one hundred and nineteen acres of land.

Now this Indenture Witnesseth that the said Thomas Tamplin for & in consideration of the sum of thirty pounds lawful money of this Government to him in hand paid by the said William Hall the receipt whereof he the said Thomas Tamplin doth hereby acknowledge and himself therewith fully satisfied contented and paid hath granted bargained and sold the by these persons doth grant bargain and sell unto him the said William Hall his heirs & assigns all and singular the above described tract or parcel of land with all & singular the buildings improvements hereditaments and appurtenance whatsoever thereunto belonging or in any wise appertaining.

To Have and to Hold the said tract of land with the appurtenances unto the said William Hall his heirs to assigns forever the said Thomas Tamplin for myself my heirs Exc’d and Adm’s do covenant promise & grant to with said William Hall his heirs & assigns that I the said Thomas Tamplin the said tract of land with the appurtenances against the lawful claim or claims of me the said Thomas Tamplin or my heirs or any other person or persons lawfully claiming by from or under me shall and will Warrant and forever defend the rents and services already due and hereafter to become one to the Chief Lord or Lords of the fee always excepted and foreprized and lastly I do authorize and impower John Rodney & John Willbank, Esq or either of them my true and lawful attorney or attorneys to appear for me in any subsequent Court of Common please to be held in at Lewes in Sussex afsd and then and there in my place & head to acknowledge this deed in open court according to Law. Sussex County: At a Court of Common Pleas held at Lewes for the County afsd the third day of May in the year of our Lord one thousand seven hundred and seventy five the within deed of sale was acknowledged in due form of law by John Willbank, Esq. Attorney of the within grantor unto the within grantee the Execution of the within deed & power of attorney being first proved in Court on the Nehemiah Davis Jur one of the subscribing witnesses thereto.
