This Indenture made the third day of August in the year of our Lord one thousand seven hundred and seventy three Between James Tamplin of the County of Sussex on Delaware of the one part and Thomas Tampling of the County afsd of the other part. Witnesseth that whereas there is a Certain Tract of Land situated lying and being in the Indian River hundred in County afsd Granted by a prepertors Warrant to a Certain Thomas Bryan late of sd County afsd deceased who by his deed of sale duly execute unto his hand and seal convey it to William Blizard and the said William Blizard conveyed the said tract of land to Ezekiel Jackson and said Ezekiel Jackson by his Writing obligatory unto his hand and seal oblidged himself to convey it to Richard Tamplin on the afsd Richard dying Before conveyance was with the said Ezekiel Jackson conveyed it to the heirs of the said Richard Tamplin and of afsd James Tamplin eldest son of the said Richard Tamplin deceased preferred a petition to the Orphans Court for the County afsd Praying that said Court to appoint five freeholders to go on the said land among the several heirs of the afsd Richard Tamplin which Petition the court was Pleas to Grant and the said freeholders after going the land made return to the said court that the said land would not bear dividing among the several heirs of the said Richard Tamplin agreeable to the directions of an act of a family in such care made and provided without spending and marring the Whole whereupon the said court appointed three freeholders to set valve upon the said land according of the Directions of the afsd Act of Assembly which said three freeholders in obedience to the said appointment made return of their valuation of the name whereupon the afsd James Tamplin Eldest son of the afsd Richard Tamplin deceased accepted the said land at the valuation there of whereby he is seized of a good title to the said land the Buts and Bounds thereof being as follows. Beginning at a corner white oak and running from thence south twenty six degrees East eighty two perches to a corner small white oak from thence south fifty nine and one quarter degrees East one hundred and forty perches to a corner post standing on the north side of a swamp then through said swamp north a quarter of a degree west sixty six perches to a corner post standing in a swamp then North one and a quarter Degrees west eighty four perches to a corner white oak then north forty six and three quarter degrees west sixty nine perches to a white oak and form thence south sixty six degrees west one hundred and four perches to a white oak then south forty nine degrees west fourteen perches to the first bounder or place of Beginning Containing and laid of for one hundred and nineteen acres of land. Now This indenture Witnesseth that the said James Tamplin for and in consideration of the sum of twenty four pounds to him in hand Paid by the said Thomas Tamplin before the signing and sealing hereof the receipt whereof the said James Tamplin doth hereby acknowledge. Hart granted bargained and sold and by these presents do Grant Bargain and unto him the said Thomas Tamplin his heirs and assigns all his Right Title Interest Property Claim and Demand of in or to the afsd tract of land together with all and singular the buildings Improvements _________ and appurtenances whatsoever unto the same Belonging or in any wise appurtaining as also all the Estate Right Title Interest Property Claim and Tenant of him the said James Tamplin of in or to every part and parcel thereof To have and to hold the afsd tract of land with the appurtenances so bargained and sold unto the said Thos Tamplin his heirs and assigns to the only Proper use and behold of him the said Thos Tamplin his heirs and assign forever and I the said James Tamplin for myself my heirs Execute & nominate ______and Grant to and with the said Thos Tamplin his heirs Excís & Adm of assigns that I the said James Tamplin the said tract of land with the appurtenances against the lawful claim or claims of me the said James Tamplin my heirs Excís and Admís and assigns to him the said Thos Tamplin his heirs and assigns to be holden of the Chief Lord or Lords of me for there of shall and forever with Warrant and Defend In Testimony whereof the said James Tamplin have hereunto set my Hand and seal the day and year first above written.
