JEREMIAH JOSEPH FROM JAMES TAMPLEN

This Indenture made the twenty ninth day of January in the Year of our Lord one thousand seven hundred and seventy four Between James Tamplin of the County of Sussex on Delaware of the one part and Jeremiah Joseph of the county afsd of the other Part Witnesseth that whereas there is a certain Tract or perch of a land situated lying and being in Indian River Hundred in the county afsd and the _______ North east side of a branch called Sockarockets Branch. Beginning at a poplar near the mouth of a small branch and running from thence north forty three and a half degrees east one hundred and two perches then north forty six and a half degrees west ninety perches to a corner post then north forty three and a half degrees east eighty nine perches to a post then north forty six and a half degrees west one hundred and seventeen perches to a red oak then south forty three and a half degrees west one hundred and sixty five perches to the afsd branch then drain of several courses of the said branch to the first bounder containing two hundred and fifty acres more or less which the land was granted by a propritaries Warrant to a certain Samuel Blundel and the said Samuel Blundel it became the Property of James Blundel son of the afsd Samuel and the said James Blundel assigned over the afsd Warrant to a certain Richard Tamplen Father of the afsd James Tamplin and the afsd Richard Tamplin dying Intestate the afsd James Petitioned the Court of Orphans for the said county of Sussex to Grant an order to divide the land of the afsd Richard Tamplin which order the said court wave ______to grant and appointed five freeholders to go on the afsd land and make return of their is doing according to law which said five freeholders did return that the lands of the afsd Richard Tamplin would not bear dividing among his _____________heirs without marring and spoiling of the hole whereupon the said court ordered three of the said five freeholds to value the said lands and make return of such valuation to the said court which return valuation made and excepted by the said court the said James Tamplin appeared in open court and did accept the afsd lands at a valuation thereof as by the return of proceedings of the said court may _________fully and at large appear. Now this Indenture Witnesseth that the said James Tamplin for and in consideration of the sum of seventy eight pounds current money of Pennsylvania to him in hand ______to be paid by the afsd Jeremiah Joseph the receipt whereof the said James Tamplin Doth hereby acknowledge Hath Granted Bargained and Sold and by these presents do grant bargain and sell unto him the afsd Jeremiah Joseph his heirs and assigns all his Right Title Interest Property Claim and Demand of in or to the afsd tract of land. Together with all and singular the buildings improvements ___________and appurtenances thereunto belonging or in any wise appertaining as also _____ Estate Right Title interest property claim and demand of him the afsd James Tamplin on in or to every part and hence thereof. To have and to hold the afsd tract of land and premise’s to bargained and sold unto him the said Jeremiah Joseph his heirs and assigns to the only proper use and behold of him the said Jeremiah Joseph his heirs and assigns forever and I the said James Tamplen for myself my heirs Exc’s and Adm;s do convenient and grant to and with the afsd Jeremiah Joseph his heirs and assigns that the said James Tamplin the said land and premise’s with the appurtenances thereunto belonging against the lawful claim or claims of me the said James Tamplin my heirs or assigns and every other person or persons whatsoever claiming and right or title thereto from by or under me them or any of them to the said Jeremiah Joseph. To be holden of the Chief Lord or Lords of me for there of shall and forever will warrant and defend. In testimony whereof I the said James Tamplen have hereunto set my hand and seal the day and year first above written.
